“Pre-prepared design”

Problem:
For this Eastern District of Texas Markman Hearing, plaintiff was alleging that our client infringed on its method for configuring products over a communications network.

Solution:
Working with the defense team, we designed and produced a DVD tutorial that visually delineated each area of our client’s methodology, which clearly provided documentation and animated sequences showing our client’s process and that they did not infringe on plaintiff’s patented methodology.

The judge agreed, supporting the bulk of our arguments and claim language. Our client won on Summary Judgment just before trial and the dispute resolved before any appeals were taken.
